CSX Transportation Sued over Asbestos-related Lung Cancer

A Kentucky man and his wife are suing railroad major CSX Transportation in over claims that the company is responsible for an asbestos-related lung cancer diagnosis. James Collier, along with his wife Mary, has filed a lawsuit on December 28, 2014 in the United States District Court for the Eastern District of Pennsylvania. The couple alleges that defendant CSX transportation negligently failed to protect its employees from hazards such as asbestos exposure.

According to the suit, James was working as a carman and a welder for the defendant between 1961 and 1978. Due to his repeated job-related exposure to asbestos products, James developed lung cancer, the lawsuit claims. James was diagnosed with asbestos-related lung cancer in 2014, according to the complaint. The plaintiffs argue that James Collier’s condition was caused by his occupational asbestos exposure. He had to deal with a variety of asbestos products at most of his work sites, the complaint states.

In their lawsuit, James and his wife are seeking in excess of $50,000 in punitive damages.
